Terms and Conditions
These terms are governed by the laws of Queensland, Australia.
1. Acceptance of terms
By accessing or using CarMarket AU at carmarket.com.au (the “platform”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform.
2. Definitions
- Buyer — a user who views or enquires about a listing.
- Private Seller — an individual selling a vehicle they own, not in trade.
- Dealer — a licensed motor dealer who lists vehicles through a dealership subscription or stock feed.
- Detailer — a business that lists car-detailing services on the platform.
- Listing — a vehicle or service advertisement published on the platform.
3. Accounts & eligibility
You must be at least 18 years old and able to form a legally binding contract to register. You must provide accurate, current information and keep your login credentials confidential. Dealers must hold a current motor dealer licence in each state/territory where they trade and provide a valid ABN. We may verify, suspend or close accounts that provide false information or operate without required licences.
4. Listings & accuracy
You are responsible for the accuracy of every listing you publish, including make, model, year, kilometres, condition, registration and roadworthy status, price and photos. Listings must not be misleading or deceptive (Australian Consumer Law, s 18). Misrepresentation may result in removal of the listing, suspension of your account, and referral to relevant regulators. Private seller listings expire after 90 days and may be renewed free of charge. We may, at our discretion, feature, reorder or remove listings.
5. Vehicle history, PPSR & roadworthiness
CarMarket AU does not verify vehicle title, finance encumbrance, written-off or stolen status. Buyers are strongly encouraged to obtain a Personal Property Securities Register (PPSR) certificate and an independent inspection before purchase. Sellers must disclose any known defect, finance owing, write-off or statutory write-off status. Where a roadworthy certificate is required by state law, the seller is responsible for providing it.
6. Stock feeds & dealership inventory
Dealers may supply inventory via a webhook push, a nightly feed URL, or a Google Sheet. You are responsible for the accuracy and lawfulness of data you push or link, and for ensuring you have the right to publish each vehicle and any images. We may pause, delay or reject feeds that contain errors, unmapped columns, or vehicles that breach these terms. Inventory is published subject to your subscribed tier cap; listings over the cap may be held back until cap room is available.
7. Messaging, contact reveal & offers
The platform provides in-app messaging, “make an offer”, and contact-reveal features. When you choose to reveal your phone or email, that information is shared with the other user. You must not use messaging to send spam, abusive, deceptive or unlawful content, or to circumvent platform fees. Offers made through the platform are expressions of interest only and do not bind either party until a separate agreement is reached.
8. Payments, subscriptions & boosts
- Dealership subscriptions are offered in tiers (Starter, Growth, Pro, Enterprise) on monthly or annual billing, with a 30-day free trial for eligible new dealers. Subscriptions auto-renew until cancelled.
- Listing boosts cost $9.99 per listing for 7 days and promote a listing above free listings in search results.
- Founding member pricing may apply to dealers who join during the founding period; the discounted rate is honoured for the stated period and reverts to the standard rate thereafter.
All payments are processed by Stripe. Prices are in Australian dollars and include GST where applicable. You can manage or cancel your subscription at any time from your dashboard; cancellation takes effect at the end of the current paid period. Refunds are considered on a case-by-case basis where required by the Australian Consumer Law; nothing in these terms excludes, restricts or modifies any non-excludable consumer guarantee under that law.
9. Car detailers & reviews
Detailers are responsible for the accuracy of their profile, services and photos. Reviews must be genuine and based on actual experience. We may remove reviews that are false, defamatory, abusive or that we reasonably believe are not authentic. Detailers may respond to reviews; we are not responsible for the content of reviews or for the quality of services provided by detailers.
10. Prohibited conduct
You must not publish fraudulent, stolen, encumbered-undisclosed, or illegal listings; impersonate another person or business; scrape or reverse-engineer the platform; attempt to access data you are not authorised to access; or use the platform to facilitate any unlawful activity. We may remove content, limit visibility, or suspend or terminate accounts that breach these terms.
11. Intellectual property
You retain ownership of content you submit and grant us a non-exclusive, royalty-free licence to host, display, reproduce and distribute it on the platform for the purpose of operating the service. CarMarket AU owns the platform branding, design and software. You must not copy or misuse our intellectual property without permission.
12. Disclaimers & liability
CarMarket AU is a marketplace and does not sell vehicles, verify title, inspect vehicles, or act as agent for either party. We are not a party to any sale and take no responsibility for the accuracy of listings, the condition of vehicles, or the outcome of transactions. To the extent permitted by law, our liability for any claim arising out of or in connection with the platform is limited to the amount you paid us in the 12 months before the claim, or AUD $100, whichever is greater. Nothing in these terms excludes liability that cannot be excluded under the Australian Consumer Law.
13. Indemnity
You indemnify CarMarket AU against any loss, damage, claim or cost (including legal costs) arising from your breach of these terms, your listings or content, or your infringement of any third-party rights or any law.
14. Dispute resolution
If a dispute arises, the parties will first attempt to resolve it by negotiation. If unresolved within 30 days, the dispute will be submitted to mediation in Brisbane, Queensland. This does not affect any rights you may have under the Australian Consumer Law or to make a complaint to a consumer protection agency.
15. Suspension & termination
We may suspend or terminate access at any time for breach of these terms, fraudulent or unlawful activity, or to protect the platform or other users. You may close your account at any time from your dashboard. Provisions that by their nature should survive termination (including liability, indemnity and intellectual property) continue to apply.
16. Changes to these terms
We may update these terms from time to time. Material changes will be notified on the platform or by email. Continued use after the effective date constitutes acceptance of the updated terms.
17. Governing law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
